- The author of the form, the designated funeral agent and 2 witnesses must sign the form.
- Default state preference funeral agent
- (1) The agent designated in a written instrument
(2) Surviving spouse or domestic partner
(3) Any of the decedent’s surviving children over the age of 18
(4) Either of the decedent’s parents
(5) Any of the decedent’s surviving siblings over the age of 18
(6) An appointed guardian
(7) Person 18 years or older now eligble to receive an estate distribution, in the following order: (a) Grandchildren; (b) Great-grandchildren (c) Nieces and nephews; (d) Grand-nieces and grand-nephews; (e) Grandparents; (f) Aunts and uncles; (g) First cousins; (h) great-grandchildren of Grandparents; (h) Second cousins
(8) The duly appointed fiduciary of the decedent’s estate
(9) Close friend or other relative who is reasonably familiar with the decedent’s wishes. This person must complete an “At-Need Written Statement of Person Having the Right To Control Disposition” form
(10) Public Administtrator, or, anyone willing to act on behalf of the decedent who completes the “At-Need Written Statement” form - Revoking a Funeral agent
- Complete a new form designating a new agent. The form revokes any prior appointment of any person to control the disposition of your remains.
- Photocopy
- A photocopy of the Appointment of Agent form is considered authentic.
