Married with no children
The spouse is entitled to all of the net estate.
Married with child or children
1)If all of the decedent’s children are also the children of the surviving spouse, the spouse is entitled to all of the net estate.
2) If one or more of the decedent’s children are not children of the surviving spouse, the surviving spouse is entitled to one half of the net estate. The children from the previous marriage receive the other half.
Order of estate distribution if spouse survives
1) Decedent’s children
2) Decedent’s surviving parents
3) Decedent’s siblings and the children of each deceased sibling
4) Nieces and nephews
5) Decedent’s grandparents and the children of any deceased grandparent.
No spouse survives but there are other relatives
1) Decedent’s children
2) Decedent’s surviving parents
3) Decedent’s siblings and the children of each deceased sibling
4) Nieces and nephews
5) Decedent’s grandparents and the children of any deceased
Order of estate distribution if decedent not married, widow or widower
1) Decedent’s children
2) Decedent’s surviving parents
3) Decedent’s siblings and the children of each deceased sibling
4) Nieces and nephews
5) Decedent’s grandparents and the children of any deceased
No surviving relatives
The estate passes to the state of Oregon.
