- Married with no children
- If the decedent leaves no children the surviving spouse is entitle to the entire intestate estate.
- Married with child or children
- 1) The surviving spouse shall receive the entire intestate estate if all of the decedent’s surviving descendants are also descendants of the surviving spouse.
2) In the event that one or more descendants of the decedent are not descendants of the surviving spouse, the surviving spouse receives one half of the intestate estate. - Order of estate distribution if spouse survives
- 1) Children of the decedent.
2) Parents of the decedent.
3) Siblings of the decedent or their descendants.
4) Grandparents of the decedent or their descendants.
5) In equal shares to the next of kin.
NOTE: If at the time of taking, surviving parents or grandparents of the decedent are married to each other, they shall take real property as tenants by the entirety and personal property as joint owners with the right of survivorship. - No spouse survives but there are other relatives
- 1) Children of the decedent.
2) Parents of the decedent.
3) Siblings of the decedent or their descendants.
4) Grandparents of the decedent or their descendants.
5) In equal shares to the next of kin.
NOTE: If at the time of taking, surviving parents or grandparents of the decedent are married to each other, they shall take real property as tenants by the entirety and personal property as joint owners with the right of survivorship. - Order of estate distribution if decedent not married, widow or widower
- 1) Children of the decedent.
2) Parents of the decedent.
3) Siblings of the decedent or their descendants.
4) Grandparents of the decedent or their descendants.
5) In equal shares to the next of kin.
NOTE: If at the time of taking, surviving parents or grandparents of the decedent are married to each other, they shall take real property as tenants by the entirety and personal property as joint owners with the right of survivorship. - No surviving relatives
- The estate passes to the state of Vermont. The court will assign personal property from the estate to the town where the deceased last lived. Proceeds from the estate are meant to be used by the town school districts.
